Terms and Conditions

*Estimates provided by JDR Painting Services, Inc., are approximate values used for budgeting purposes and should not be construed as a contract for services or a guarantee of actual costs. All estimates are subject to change based on labor and material price fluctuations, unforeseen circumstances, and/or customer-requested changes.

**Terms and Conditions of JDR Painting Services, Inc.**

 

**1. General**
These Terms and Conditions ("Terms") govern all painting services provided by JDR Painting Services, Inc. ("the Company") to you, the Client. By engaging the services of the Company, you agree to be bound by these Terms, which form a legally binding contract between the Client and the Company.

 

**2. Services**
The Company agrees to perform the painting services ("Services") described in the Service Agreement or Quote provided to the Client. All Services will be completed in a professional manner, in accordance with industry standards.

 

**3. Quotations and Estimates**
Quotations provided by the Company are valid for a period of 30 days from the date issued. Estimates are approximate and are subject to change based on actual measurements and unforeseen work that may be required.

 

**4. Payment Terms**
Payment for Services is due as follows: full material deposit upon commencement of work, with the balance due upon completion of the Services. Late payments shall incur a late fee of 1.5% per month on any outstanding balance.

 

**5. Changes and Cancellations**
Changes to the scope of Services requested by the Client must be agreed upon in writing and may result in adjustments to the fees and completion schedule. Cancellations by the Client less than 48 hours before the scheduled start date will result in a forfeiture of the deposit.

 

**6. Liability**
The Company is not liable for delays in completion caused by factors outside of its control, including but not limited to weather conditions, availability of materials, and client delays. The Company shall not be liable for incidental, indirect, special, or consequential damages arising from the contract.

 

**7. Warranty**
The Company provides a full material warranty.  It does not cover damage caused by external factors such as weather or physical impacts after completion.

 

**8. Client Responsibilities**
The Client is responsible for removing personal property and furnishings from the work area prior to the commencement of Services and for providing access to power and water sources. The Company is not responsible for damage to property not removed or protected by the Client.

 

**9. Dispute Resolution**
Any disputes arising from these Terms or the Services provided shall first be attempted to be resolved through direct negotiation. If the dispute cannot be resolved, both parties agree to settle the dispute through binding arbitration, with arbitration costs to be shared equally between the Client and the Company.

 

**10. Governing Law**
These Terms shall be governed by and construed in accordance with the laws of the state of Kansas.

 

**11. Amendment**
These Terms may only be amended in writing, signed by both the Client and a duly authorized representative of the Company.
